A farmer from Co. Galway, Michael Knightly, has been granted High Court permission to challenge Galway County Council’s decision to zone his land as liable for the Residential Zoned Land Tax. Knightly argues the designation is disproportionate, objectively biased, and breaches fair procedures, EU directives, climate policy, and Constitutional justice.
He says he has sustainably farmed the land for 20 years and that the tax could force him to sell it. The council maintains the site is strategically located and suitable for development to support compact urban growth. Ms Justice Sara Phelan granted leave for judicial review, with the case returning in January.
